SpeakApp AI (“We” or “us”) are committed to protecting and respecting your (“you” or “user”) personal data privacy and complying with data protection principles and provisions under applicable laws.
This Privacy Policy describes what personal data we collect, how we use it and why, determining the purposes and means of the processing, when you use and/or access our proprietary mobile application and website known as SpeakApp AI and the content, features and services therein (collectively, “SpeakApp”).
Please read this Privacy Policy carefully. When it necessary under applicable law, by continuing to use SpeakApp AI (in whole or in part) in any way or manner you are agreeing to the processing operations we disclosed in this Privacy Policy. If you do not understand and/or agree to this Privacy Policy, you should immediately stop using SpeakApp AI.
This Privacy Policy forms part of our Terms of Service, which describes the terms under which you use our Services and which are available at https://speakapp.com/terms This Privacy Policy should therefore be read in conjunction with those terms.
1. What Personal Data We Process
1.1 We process Personal Data:
- provided by you, such as account data – your e-mail address (optional), your role (optional) (occupation); content data – Personal Data in audio recording and text; communication data – Personal Data in enquires to the customer support.
We do not require you to provide your email. You can start using SpeakApp without creating an account. In this case a random user ID is assigned. You can choose to create an account using your email to be able to store your recordings securely and sync your data across multiple devices.
We do not use audio recordings for identification purposes and do not attempt to identify you based on the voice in audio recordings.
- collected by SpeakApp and generated while using SpeakApp, such as account data - generated user ID; content data – audio recording transcriptions and edited text; technical and usage data – your device, network and OS information, IP address, session logs, cookies (see our Cookie Policy); payment data – purchase history and billing information (no bank card information processed).
1.2 We do not knowingly collect, use, or disclose Personal Data from individuals under 18 years old, nor do we offer or target our services to them.
2. How and Why We Process Personal Data
2.1 We process your Personal Data:
- to setup your account, provide SpeaskApp service ensuring it normal functioning, provide a customer support – based on a contract (Terms of Service).
To provide you a service we need to collect and process your Personal Data. We won’t be able to provide SpeakApp service without such data processing.
- to analyze the SpeakApp conversion, usability, and performance – based on our legitimate interest in improving the product, analyzing and adjusting business and marketing strategies to increase the number of users.
2.2 We transfer (disclose) some Personal Data to the following partners and vendors:
Partners that maintain the SpeakApp service, such as hosting and computing providers, authorization service providers (OAuth), infrastructure monitoring and analytics system providers, speech-to-text and transcription AI-powered solution providers, software and SaaS providers of our internal CRM and ticket systems, mailing system providers, payment service providers.
We use hosting and cloud computing providers to store your audio recordings and transcriptions in the data centers within EU, including Germany and Finland, that have appropriate security measures and certifications, such as ISO 27001, ISO 27018, ISO 27701.
Subject to the EU data protection laws, some of our partners are located in third countries, considering that some of these countries, including the U.S., may not provide the same level of data protection as the EU, as determined by the European Commission. When transferring your data to such partners, we implement necessary data protection measures and follow required procedures to ensure the protection of your data and your rights as a data subject, including Standard Contractual Clauses approved by the European Commission, EU-U.S. Data Privacy Framework vendor assessment, and transfer impact assessments.
Most of the providers, including AI service providers, process data solely on our documented instructions and are contractually prohibited from using such data for their own purposes.
- authorities to whom we have a legal obligation to disclose data upon request: courts, law enforcements, data protection agencies.
- successors to our business or assets: in case of a business transaction, merger, acquisition, corporate restructuring, sale of assets.
3. How Long We Keep Personal Data
3.1 Unless stated otherwise in this Privacy Policy, your Personal Data will be stored and processed for as long as it is necessary to achieve the purposes of processing (e.g. to fulfill our obligations in respect of the provision of SpeakApp service), but no longer than 1 years after your account deletion or your last interaction with us (whichever occurs later), in accordance with the limitation period for legal claims.
3.2 Your purchase history will be stored as stipulated in the applicable law.
4. Security of Processing
4.1 We implement appropriate measures, data protection principles, contractual safeguards, and conduct necessary assessments to ensure the confidentiality and security of your data and to process it in compliance with applicable laws, whether by us or our partners, contractors, and vendors, including in cases of the cross-border data transfers.
Such measures include (but not limited to) that your Personal Data is stored encrypted and the encryption keys in each case are stored in other data centers in different jurisdictions; this way local engineers or physical intruders cannot get access to user data; as well as the measures of pseudonymization of Personal Data and encryption at rest and in transmit, access management system and documenting (logs), confidentiality commitments of staff and access control on a ‘need-to-know’ basis.
4.2 We shall notify you by email immediately if any data breach occurs that may threaten your rights and privacy, as stipulated in the applicable law, and provide you a guideline on how to mitigate that risk.
5. Your Rights and Deleting Data
You Have the Right to
5.1. Access the information about what data we process about you, why and how, and to get a human-readable copy of it;
5.2. Rectify or correct an inaccurate or incomplete data about you;
5.3. Erase or delete your data held by us, unless we are required to keep it, mandatory (according to the law) or legally (e.g. to deal with legal claims, to support the freedom of expression and information).
You can delete all your recordings (e.g., delete stored recordings) in Settings > Data Management -> Delete all recordings (using our mobile app).
You can delete your SpeakApp AI account under the account label in app's settings. Your email and any other related information will be deleted at this point;
5.4. Restrict the processing of your data, if you challenge the lawfulness of the processing, data accuracy, or our legitimate interest, or if you need the data retained for legal claims;
5.5. Data portability, meaning that if we process your data by automated means based on consent or contract, you have right to get a copy of your data in machine-readable format to transmit it to another data controller of your choice;
5.6. Object (1) to the processing of your data for direct marketing purposes at any time, by opting out following the instructions in the marketing message, or by sending us a request, and (2) to the processing based on legitimate interest, if you believe it violates your rights;
5.7. Not be a subject of automated individual decision-making and profiling, unless you have given your consent or it is necessary for performance of a contract with you;
5.8. Lodge a complaint about processing of your data with us, or with the data protection authority of your place of residency if you believe your rights have been violated;
5.9. Exercise these rights through your account settings (where applicable), or by sending us a request by email in section 7.
6. Changes to this Privacy Policy
6.1 We will review and may update this Privacy Policy from time to time. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on this page www.speakapp.com/privacy. Please check our website frequently to see any updates or changes to our Privacy Policy. Continued use of SpeakApp service after the effective date means that the updated Privacy Policy applies to covered processing activities.
6.2 We will inform you by any available means (in-app notification, e-mail) when the processing of your data has been significantly changed and the Privacy Policy amends accordingly.
